Indonesian two star police general sentenced to a decade in jail

The former chief of Traffic Police Corps, Inspector General Djoko Susilo, was sentenced to 10 years in jail and fined Rp500 million for corruption linked to a driving simulator project.

"Inspector General Djoko Susilo is proven guilty of corruption and involvement in a number of crimes and is sentenced to 10 years in jail and fined Rp500 million or six months more in jail," chief judge Suhartoyo said in a corruption court session.]

The sentence was lighter than the prosecutor`s demand, which was 18 years in jail and a fine of Rp1 million or one more year in jail for failing to pay it in addition to Rp32 billion in damages or five more years in jail for failing to pay it.

The prosecutor has also demanded the revocation of his right to vote and to be voted for a public office.

"The council of judges think the prosecutor`s demand is too heavy while they consider the sentence has met the sense of justice as it could be used as a momentum for the convict to repent," judge Anwar said.

The council of judges in its verdict also ruled that Djoko need not pay damages worth Rp32 billion as demanded by the prosecutors.

"The demand is not met because some assets have been confiscated," Anwar said reading the verdict.

Regarding the demand for the revocation of Djoko`s political right judges had also denied.

"The judges would not revoke the convict`s political right because he is already sentenced to jail for a long time so that he would automatically be screened by existing political regulatons," he said.

Djoko`s assets would be confiscated except three namely a plot of land and a house on Jalan Cendrawasih in Tanjung Barat Mas under the name of Mahdiana, a Toyota Avanza car under the name of Sonya Mariana Ruth Warouw and a Toyota Avanza car under the name of Muhammad Zainal Abidin.

Upon hearing the verdict Djoko said he would appeal it. "We will appeal the verdict," Djoko`s lawyer Juniver Girsang said.

Prosecutor from the Corruption Eradication Commission, Kemas Abdul Roni, said there are few points in the judges` verdict that he did not agree with but he said he still had yet to discuss with his colleagues whether or not he would appeal the ruling.

KPK investigating recipients of Bank Century`s bailout fund

The Corruption Eradication Commission (KPK) is investigating the recipients of Bank Century`s bailout funds, amounting to Rp6.7 trillion, in the corruption case of the bank`s short-term funding facility (FPJP).

"KPK wants me to provide details of the Rp6.7 trillion bailout funds - where the funds were transferred and the recipients of the funds," said Robert Tantular on Monday.

Robert was also questioned on Friday (Sept 13) on the same case.

"I am unsure because I was detained at the Police Headquarters at that time," he added.

Robert Tantular in prisoners car.
He is unsure if the former president director of Bank Mutiara, Maryono, knew about the disbursement of the bailout funds. Bank Mutiara is the name of Bank Century after it was taken over by the Deposit Insurance Agency (LPS).

On Friday, Robert explained the chronology of the bailout fund request. On October 29, 2008, the management of Bank Century applied for a repo asset facility worth Rp1 trillion at Bank Indonesia (BI/the central bank).

But BI did not grant Bank Century its request. On November 13, 2008, Bank Century suffered from a default problem. So, on November 14, 2008, BI provided Bank Century FPJP amounting to Rp689.

On Monday, the KPK was scheduled to question BI`s Macro-prudential Policy Director Agusman on the same case.

Robert is now serving a nine-year jail term at Cipinang Penitentiary, East Jakarta, because he has been proven guilty of committing three bank crimes.

The Bank Century case opened in late 2008, when the bank faced liquidity and default problems during the crisis.

It collapsed after its liquidity assets amounting to about Rp11.6 trillion were withdrawn, through its security firm Antaboga Delta Sekuritas, and stashed abroad by its owner Robert Tantular.

The ailing bank was then taken over by LPS. Fearing its systemic adverse impact, the government provided bailout of Rp6.7 trillion, through the issuance of FPJP and Temporary Capital Participation (PMS).

The amount provided was far higher than the Rp1.3 trillion then discussed with the House of Representatives (DPR). Thus, the bailout sparked public criticism as it was disbursed without approval from the DPR.

Later, DPR set up an inquiry committee to look into possible violations in the provision of the bailout.

At the end of their inquiry, at the plenary session, seven of the nine factions of the House in the committee mentioned that violations had been committed with regard to the issuance of FPJP and PMS.

KPK and PPATK to synchronise public office candidate data

The Corruption Eradication Commission (KPK) and Centre for Financial Transaction Reporting and Analysis (PPATK) will synchronise public office candidate data, said PPATK`s head M. Yusuf on Monday.

M. Yusuf.
"Certain things need to be synchronised. However, since it is a secret, I cannot reveal the prospective official figures; there are new findings that need to be addressed by the KPK," added Yusuf.

Yusuf mentioned that the officials are from a ministry; however, he refused to explain more about the meeting to discuss the flow of funds of several cases handled by KPK.

"In addition, we will convey all that needs to be explored," he said, when questioned about the flow of funds of the Upstream Oil and Gas Special Task Force (SKK Migas) bribery case.

However, he emphasised that PPATK does not look at individuals but transactions related to the case.

"We do not look at individuals; we are interested in the transactions," he said.

Earlier, Yusuf admitted that he had understood the flow of funds involving SKK Migas officials in the bribery case.

Funds came from foreign companies in foreign currencies, but Yusuf did not mention the flow of the funds.

"The investigators have confiscated 15 boxes of documents," Johan Budi said.

Tubagus Chaeri Wardana alias Wawan has been named a suspect for allegedly having bribed former Constitutional Court Chief Judge Akil Mochtar in connection with a dispute over Lebak district head`s election results.

KPK has confiscated Rp1 billion in Rp100 thousand and Rp50 thousand notes, put into a travel bag from the house of the parents of Susi Tur Handayani, who would hand over Wawan`s money to Akil Mochtar.

The panel of Constitutional Court judges, led by Akil Mochtar on October 1, 2013, decided to grant the appeal of Amir Hamzah-Kasmin from Golkar Party, following their loss and order the General Elections Commission chapter of Lebak district in Banten province to repeat the vote for the election of Lebak district`s head.

Wawan`s lawyer on Monday denied his client`s involvement in the legal district head`s election.

He also said Susi is not the lawyer of a conflicting party in the dispute in Lebak head`s election but a lawyer for a party in the dispute over Serang mayor`s election.

The post of Serang mayor is now held by Tubagus Haerul Jaman, who is also Ratu Atut`s half-brother.

Several relatives of Ratu Atut are holding various government positions in Banten province and also at a national level - Hikmat Tomet, who is her husband, is a member of the House of Representatives` Commission V; Andhika Hazrumy, the first son of Ratu Atut, is a member of the Regional Representatives Council of Banten province; and Ade Rosi Khairunnisa, wife of Andhika, is a deputy speaker of the Serang city legislative assembly.

Andiara Aprilia Hikmat, the second child of Ratu Atut, meanwhile, is a candidate for House of Representatives membership, while Tanto Warsono Arban, Andiara's husband, is also a candidate for the House of Representatives membership.

Heryani, step mother of Atut, is currently the head of Pandeglang district and Ratu Tatu Chassanah, sister of Ratu Atut, is deputy head of Serang district.

Ratu Atut`s step brother, Tubagus Chaerul Jaman, meanwhile, is the mayor of Serang, while Airin Rachmi Diany, wife of Wawan, is the mayor of Tangerang Selatan.

KPK has named Akil Mochtar as a suspect in connection with the disputes over the elections of district heads of Gunung Mas in Central Kalimantan province and Lebak in Banten province.

It has also named parliamentary member Chairun Nisa from Golkar Party and Gunung Mas district head Hambit Bintih and Cornelis Nalau, a businessman, as suspects in connection with Akil`s case.

KPK has confiscated S$284,050 and US$22 thousand in connection with the case.

In the case of election dispute in Lebak, Akil and Susi Tur Handayani have been named suspects for allegedly receiving bribes while Tugagus Chaery Wardana has been named a suspect for paying the bribes.

Banten province has so far been known as the stronghold of Golkar Party, which is one of the biggest political parties in the country.

Governor Ratu Atut meets KPK`s summons

Ratu Atut Chosiyah
Governor of Banten Province Ratu Atut Chosiyah arrived at the Corruption Eradication Commission (KPK) building here on Friday in response to the agency`s summons to testify over a local election dispute.

She arrived at around 1:30 p.m. wearing a black Muslim headscarf, a purple batik tunic, and black trousers.

Upon arrival, she made no comment but flashed a smile at newsmen who had been anticipating her appearance before immediately entering the building.

The politician from the Golkar Party, one of the country`s largest parties, has been accused of having a vested interest in the victory of her party`s candidate in the election of the Lebak district head in her province.

Golkar`s candidate Amir Hamzah, pairing with Kasmin, had filed a lawsuit with the Constitutional Court over the results of the vote that favored his rival, Iti Octavia Jayabaya, who had been running with Ade Sumardi.

The panel of judges led by Chief Justice Akil Mochtar on Oct. 1 ruled that the vote must be repeated.

Akil Mochtar was recently named a suspect by the KPK in connection with an alleged bribery case linked to the election in Lebak.

Atut, meanwhile, has been banned by the KPK from traveling abroad until the case is resolved.

Several of Atut`s family members are known to hold a public office in the province as well as at the national level.

Her younger brother, Tubagus Chaery Wardana, has also been named a suspect in connection with the alleged bribery case involving Akil Mochtar and the election in Lebak.
